Uh oh, is that my face there?

“There is a picture of us in the National Post”

That was a SMS from Julien around 18h. Pick up the National Post and yeah, there is a huge picture of us – the picture that was used last week for The Gazette coverage about my show. So they basically used this picture of us beside an article about podcasting taken from the Financial Times…

They used our faces in real big (amazing i tell ya) and didnt even asked or noticed us about the use of this picture that was taken for another newspaper.

Can we do something about that beside sending them a mail telling them that we are kinda’little pissed off?

  1. National Post and The Gazette are owned by the same company. It would of been nice of them if they told you but I guess they don’t feel the need to.

  2. john: yeah, that was my instinct. it’s just a matter of them looking into their archives for the keyword ‘podcast’ and seeing what’s available. cheaper than using a new photo. sux but that’s the game.

  3. They don’t need your consent if the image is used for editiorial (aka news) purposes.

  4. They don’t need your consent at all and your pic is now all over North America and the world by now.

    Pics like that are great for medias and can be used with all sort of articles – IT, new technologies, net, computers, you name it.

    Once they newspaper take your picture and you give them the right to use that picture, they will usually send it to Canadian Press (that’s the PC/CP you see at the beginning of articles, briefs and under pics in the medias). Whatever that goes to CP is then relayed to all CP members (pretty much all and every newspaper in the country and the USA subscribe to that. In addition, some CP content can, depending on its usefulness, be forwarded to news agencies all over the world.

    A friend of mine was in one pic 12 years ago and he still is seen regularly in some newspapers! And as a PR/marketing person, I love that cause it means pics taken at some of my events are still in the newspapers and seen by thousands and thousands of readers (free publicity) years after!

    If you authorized the media to take the pic, there is’nt much you can do other then enjoy it! Unless you specifically told them NOT to send this to CP…Doubt you did…

Unless you specifically told them NOT to send your pic to CP, then your pic is probably all over the world by now. 99,9% of all newspapers in the country are members of CP and they send they stuff to it. Which means pretty much all medias in North America got your pic and, depending on usefulness, pics can be relayed to news agencies all over the world.

    As long as it’s not used for commercial purpose, there is nothing you can do.

    so basically, a picture of us could be used beside an article about anything?

  7. You don’t need to sign a “release form”. The standard in medias is that is people were obviously aware of 1) someone taking a pic and 2)that this pic was use in X media, then, you agreed with having your pic taken and then used by that media.

    And the “use by that media” part includes sending it to their news agencies, which can be CP, AP, FP and you name it.

    And yeah, your pic can be used for pretty much anything that the medias sees fit. Internet, laptops, IT, new technologies, … alouette!
